In these Terms of Use, “we”, “our”, and “us” refer to Utility Market; “you” or “your” refers to the user of the Website or our services.

1.2 These Terms govern your use of the Website and services, including our comparison and referral services across energy, broadband, and private health insurance products.

3.1 Utility Market provides a free platform to compare and connect you with energy, broadband, and private health insurance providers.
3.2 We are not a provider of these services. Contracts are entered into between you and the selected provider.
3.3 While we aim to present accurate, current information, we do not guarantee all offers are available or free from error.
4. Our Commitments to You
4.1 We act in your best interests, placing your needs before our own or any third party’s.
4.2 We receive a commission from the provider you choose if you proceed with a product via our platform. You do not pay us for our comparison or support services.
4.3 We disclose our commissions, benefits, and provider relationships transparently upon request.
4.4 We uphold the principles of the Private Health Insurance Intermediaries Association (PHIIA) Code of Conduct and nothing in these Terms limits or overrides our obligations under that Code.
4.5 We will not exclude or limit liability in relation to any personal one-on-one advice we provide under this Code.
4.6 We perform our services with competence, integrity, honesty, and care.
4.7 We comply with all relevant legislation including:
- Private Health Insurance Act 2007
- Privacy Act 1988
- Competition and Consumer Act 2010
- State and Territory Fair Trading legislation 8 We disclose actual or potential conflicts of interest and maintain appropriate records. 4.9 We assist customers in understanding and completing their chosen provider’s onboarding process.
5. Funds and Products Compared
5.1 In relation to private health insurance, we compare a range of products from selected providers. As of the date of this policy, we compare products from the following funds:
AHM, HCF, HIF, Hunter Health, NIB, RTH, GMHBA, Frank, HCi, Real Insurance, and Seniors Health Insurance.
5.2 Please note: Not all private health insurance funds or products available in the market are compared through our platform. The comparisons may not include all of each fund’s product range.
6. User Responsibilities
6.1 You agree to:
- Use the Website only for lawful, personal, and non-commercial purposes
- Provide accurate and complete information when using our services
- Not disrupt, misuse, or harm the Website or services

10. Limitation of Liability
10.1 Our services are provided on an “as is” basis.
